Assumptions about obesity—e.g., its connection to ill health, its causes, etc.—are still prevalent today, and they make up what I call the medical model of fatness. In this paper, I argue that the medical model was established on the basis of insufficient evidence and has nevertheless continued to be relied upon to justify methodological choices that further entrench the assumptions of the medical model. These choices are illegitimate in so far as they conflict with both the epistemic and social aims (...) of obesity research. I conclude the paper with a partial solution to these epistemic and social shortcomings. (shrink)

Enhancing body awareness has been described as a key element or a mechanism of action for therapeutic approaches often categorized as mind-body approaches, such as yoga, TaiChi, Body-Oriented Psychotherapy, Body Awareness Therapy, mindfulness based therapies/meditation, Feldenkrais, Alexander Method, Breath Therapy and others with reported benefits for a variety of health conditions. To better understand the conceptualization of body awareness in mind-body therapies, leading practitioners and teaching faculty of these approaches were invited as well as their patients to participate in focus (...) groups. The qualitative analysis of these focus groups with representative practitioners of body awareness practices, and the perspectives of their patients, elucidated the common ground of their understanding of body awareness. For them body awareness is an inseparable aspect of embodied self awareness realized in action and interaction with the environment and world. It is the awareness of embodiment as an innate tendency of our organism for emergent self-organization and wholeness. The process that patients undergo in these therapies was seen as a progression towards greater unity between body and self, very similar to the conceptualization of embodiment as dialectic of body and self described by some philosophers as being experienced in distinct developmental levels. Jean-Luc Nancy’s work revolves around the concept of existence, modified or rather explicated as co-existence. Nancy performs the same operation on existence as Heidegger did on being-in-the-world. Indeed, just as Heidegger could say that there is not at first a subject, then a world, then the question of how the former accesses the latter, Nancy asserts, (with regard to Mitsein, being-with, sociality in the purest and most eminent sense), that there is not at first a subject, a self, then another (...) self, then the question of how one accesses the other, and how they can communicate together. We have to start from “us”, and from the sense that “we” are, i.e. from a “coexistential analytic”. (shrink)

Los Comités Hospitalarios de Bioética (CHB) tienen la atribución de emitir sugerencias al personal de salud, ante casos clínicos difíciles que involucran problemas y/o dilemas bioéticos. A nivel mundial, y también en México, se encontró poca literatura relacionada, generando en ocasiones cierto grado de incertidumbre en los profesionales de la salud para su resolución. Objetivo: describir los motivos de presentación de casos clínicos de pacientes ante el CHB en un hospital de segundo nivel, desde junio de 2007 a junio de (...) 2018. Método: estudio observacional, descriptivo, retrospectivo y transversal; la muestra fue por conveniencia y se obtuvieron 48 registros de minutas. Resultados: el motivo de consulta más frecuente ante los CHB fue el apoyo en la decisión para la limitación del esfuerzo terapéutico, con 24 casos (50%). Se identificaron 34 dilemas bioéticos (71%) y 14 problemas bioéticos (29%). Conclusiones: ayudará a los servicios médicos tratantes a identificar e intervenir oportunamente, al basarse en situaciones previas sobre dilemas y/o problemas bioéticos. (shrink)

Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

This essay compares Alasdair Maclntyre's and Basil Mitchell's recent work in religious ethics and ethical theory. The focus is on the interconnections among theories of human nature, sociocultural context, moral thought, and theories of rationality, all of which have a bearing on our prospects for assessing moral traditions. While I note many of the striking parallels between their positions, I also point out that they differ regarding their appreciation of the impact of social and cultural context on morality. In distinction (...) from Maclntyre, Mitchell combines an appreciation for moral tradition with an awareness that in order to assess traditions we must have some critical resources that are relatively tradition-independent. He finds these in theories of human nature and in general standards of rationality. Furthermore, from Mitchell's perspective, Maclntyre seems to employ similar resources in developing his position. Ecofeminists, environmental activists, and ecologists are calling humans to change our relationships to other-than-humans and more-than-humans. Indigenous people and knowledge systems are often exemplified as ways for non-Indigenous people to relate to these entities. While Indigenous people have historically participated in epistemologies and modes of perception that rendered them more able to connect to non-humans, these relationships have not always been peaceful or mutually advantageous. Examples are cited in which annihilating all beavers was the goal, and the fur trade is (...) cited as a time when Indigenous people in North America gained mastery over animals that had previously threatened them, leading to near extinction for some species in some locations over a short time. Bear–human marriage stories provide us with another way to view the human–animal relationship, which is sometimes violent. Through multiple conversations with Elders over time, I have been accumulating a sense of Indigenous North American (INA) theories of mind, self, and consciousness. I apply the results of my discussions to the question of whether we are creating a new consciousness of relations with non-humans that has not previously existed in INA thought, though it has its progenitors. I also apply insights from recent literature on psychedelics. This new thought arises from the current domination of the planet and animals by human beings and the relative lack of threat to humans from animals. Indeed, we are more dangerous to them than they are to us. Within this context, we can construct a new consciousness of non-humans, which has its historical antecedents and which is also entirely new. (shrink)

Kierkegaard is considered in light of the contemporary debate over rationality and relativism, especially as it pertains to his understanding of human moral existence. He is interpreted as providing a philosophical anthropology as a basis for affirming responsible personhood. The Kantian and, more briefly, the Hegelian and Aristotelian influence on his views are discussed, and it is argued that Kierkegaard draws on these to formulate a view of the universally human as the potential possessed by each individual which is to (...) be actualized. This view is distinguished from, yet encompasses, the human being as "subjective actuality" which is relative to each individual, and as "empirical actuality," which is peripheral and variable. Finally, his view of essential humanness is interpreted as formulated by employing a "radical empiricism" of the lived-experience of actually searching for a meaningful perspective on human "praxis," a "method" that draws on a comprehensive conception of rationality. Brent Kious has objected to our previous criticism of his views on doping, maintaining that we, by and large, misrepresented his position. In this response, we strengthen our original misgivings, arguing that (1) his views on risk of harm in sport are either uncontroversially true (not inconsistent with the views of many doping opponents) or demonstrably false (attribute to doping opponents an overly simplistic view), (2) his use of analogies (still) indicates an oversimplification of many issues surrounding the question of (...) doping in sports, and (3) his doping analogies are insufficiently precise to support his conclusions. In this essay I argue that liberal arts education must reject scientism and embrace tmths about human flourishing, tmths that can be supported by both traditional wisdom and recent scientific studies. Liberal arts education can speak to the human spirit's yeaming for moral and spiritual meaning in life, and can help students come to terms with this interest. Current research into human flourishing enables us to make a more persuasive public case for the importanceof liberal arts education, and specifically for (...) it as education for our moral and spiritual lives. Power and its Number, from Abelard to Kepler. Catholic theology has always held, contrary to what the philosophers say, that God can do everything: his power is infinite, he always has a reserve of power and this reserve is not exhausted in the opus creationis. Thus, God's power is divine because it is incomprehensible. Therefore, there is an essential equivocity in the potentia Dei, which cannot be confused with the power of nature. What are examined here instead are some of (...) the arguments in favor of the opposite thesis. Let us take seriously a logical objection: by saying that divine power is inexhaustible, is this not to assert the impossibility of its being exhausted and, in so doing, to impose on it a limit which, by definition, it cannot bear? Should not a consistent theology refrain from considering the divine power according to comparisons borrowed from the kingdom of created things? Kepler's attempt to think of nature as a pure Trinitarian symbol seems in this respect to deserve special attention. (shrink)

From the Adriatic to the Baltic, from the Elbe to the Urals and beyond, totalitarianism has collapsed. Yet the 1989 bloodless revolution in Eastem Europe caught most observers by surprise. This essay explores the signal socio-cultural forces which contributed to the sea-change. Throughout Eastem Europe, grassroots movements emerged in the 1970s and 1980s demanding greater participation in social, economic, cultural, and political life. Thus, the rise of a new civic culture and civil society preceded and fostered the momentous changes in (...) Eastem Europe, This essay offers a model of transition from authoritarian systems to political democracy, highlighted by "The Menshevik Divide," and places East European nations and the USSR on a cognitive map which indicates the relative strength of civic values and autonomous action just before the revolution (1988), Curiously, this model also shows why the transition remains incomplete, since authoritarian values and political processes keep many post-communist systems in a twilight zone between democracy and dictatorship. Hence, the quest for universal human rights, democracy, pluralism, tolerance, and an open society is still a futuristic project in much of Eastem Europe and the Soviet successor states, suspended between democracy and "virtual communism.". This essay considers Medjugorje, a small mountain village in Bosma-Hercegovina, as an icon or a bridge between God and man. The contemporary quest for national roots in the Balkans has led to cultural policies in the Yugoslav successor states which deny all common bonds among the South Slavs, resulting in a Kafkaesque civil war. Drawing on the crisis of liberal democracy and community in the West, the essay explores the prospects for peace in the former Yugoslavia, as reflected in Our (...) Lady of Medjugorje's call for moral and spiritual renewal. It concludes that the quintessential, universal. Christian, and ecumenical Medjugorje message of peace represents a bridge to eternity, just as the historic Old Bridge in Mostar and the Višegrad Bridge over the Drina River are symbolic of a common South Slav history and destiny.
